What is litigaiton?
Litigation simply means the process of taking legal action. It is the proceedings, typically called called a lawsuit, initiated between two opposing parties of an disagreement to enforce or defend a legal right. It can either be settled before going to trial or heard by a judge or jury in a court house.
Does it include mediation?
No. Litigation refers to the traditional court process and does not involve alternative dispute resolution, such as mediation or conflict resolution.
Is it expensive?
Litigation may be more expensive than mediation because you have less control over your costs. Legal fees and representation retainers varies and is based on what services will be needed and the complexity of the case.
How long does it take?
There isn’t a set length of time, however litigation cases often lasts longer than cases that either settle outside of court or go an alternative legal route. The court case can be slow moving, with the court establishing the timing of your case.
